Agreement to these terms

These Terms of Service (“Terms”) govern your use of samediallc.com (the “Site”) and your engagement of the services offered by S A Media LLC (“S A Media,” “we,” “us,” or “our”). By accessing the Site or submitting an enquiry, you agree to these Terms. If you do not agree, please do not use the Site. If you engage us for services, a separate written agreement (proposal, statement of work, or invoice) will govern the specific scope, deliverables, timelines, and fees, and will control in the event of any conflict with these Terms.

About S A Media

S A Media LLC is a digital growth agency based in Albuquerque, New Mexico, serving contractors and home-service businesses across the United States. We build a connected 3-Step Scale System: a fast, conversion-focused website; a private lead-management dashboard; and managed Google/Meta paid-ad campaigns designed to generate booked jobs.

Using this site

This Site is provided for information about S A Media and its services. Content may change without notice and does not constitute a guarantee of specific business results, revenue, lead volume, or advertising performance. You agree to use the Site lawfully and not to misuse it, including not attempting to disrupt, reverse-engineer, or gain unauthorized access to any part of the Site or our systems.

Enquiries and no obligation

Submitting an enquiry or scheduling a strategy call does not create a business relationship or obligate either party to engage in services. A service engagement begins only when both parties sign a written agreement and any required deposit is paid. Until then, information exchanged during calls or emails is non-binding.

Engagements and deliverables

Project scope, deliverables, timelines, milestones, and fees for the website, dashboard, and paid-ad services are set out in a separate written agreement. We work in defined phases (for example, website build, dashboard setup, and ongoing ad management). Ad campaigns are managed on a best-efforts basis; advertising platforms such as Google and Meta are third parties whose policies, performance, and availability are outside our control.

Client responsibilities

To deliver our services effectively, you agree to provide timely access to required accounts, brand assets, business information, approvals, and feedback. Delays in providing these may affect timelines and outcomes. You are responsible for the accuracy of the information, content, and access you provide to us, and for complying with applicable laws and advertising-platform rules related to your business and ads.

Payment and fees

Fees, payment schedules, and accepted methods are specified in your written agreement. Unless otherwise stated, invoices are due as agreed, and services may be paused or withheld for overdue balances. Ad spend and any third-party platform fees (such as Google or Meta ad budgets) are separate from our service fees and are the client’s responsibility.

Refunds

All fees paid to S A Media LLC are non-refundable. Because our services involve significant time, labor, and committed resources from the start of an engagement — including strategy, design, development, and ad account setup — we do not offer refunds for any services rendered, deposits paid, or work in progress. Please review our Refund Policy for full details, and consider your decision carefully before engaging.

Intellectual property and ownership

On full payment of all amounts owed, the website and dashboard we build for you are yours outright. Our own tooling, templates, frameworks, internal systems, processes, and methodologies remain the property of S A Media LLC, and you receive a license to use any such embedded elements solely as part of your delivered project. Content, branding, and assets you provide remain your property.

Confidentiality

We respect the confidentiality of information you share with us and will use it only to provide our services. We will not disclose your confidential business information to third parties except as necessary to deliver the services (such as to advertising platforms) or as required by law.

Third-party services

Our services may involve or connect to third-party platforms such as Google, Meta, hosting providers, and analytics tools. We are not responsible for the availability, policies, performance, or actions of these third parties, and your use of them is subject to their own terms.

Limitation of liability

To the fullest extent permitted by law, S A Media LLC is not liable for any indirect, incidental, special, or consequential damages, including loss of revenue, profits, leads, or data, arising from the use of the Site or our services. Our total liability for any claim related to services is limited to the amount you have paid us for the specific service giving rise to the claim. We are not liable for issues caused by third-party platforms, inaccurate information provided by you, or your failure to follow our recommendations.

No warranties

The Site and services are provided “as is” without warranties of any kind, express or implied. We do not guarantee specific rankings, traffic, leads, sales, or advertising results, as outcomes depend on many factors outside our control, including market conditions, competition, and your business offering.

Termination

Either party may end an engagement as provided in the written agreement. Upon termination, you remain responsible for fees accrued up to the termination date and for any non-refundable costs already committed. Sections that by their nature should survive termination — including those on payment, refunds, intellectual property, and limitation of liability — remain in effect.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Site after changes constitutes acceptance of the updated Terms. Service engagements remain governed by their signed written agreement.
